Terms
Last updated: 9 October 2026
These terms apply when you book a game or tour with GPS City Game, buy a gift card, use an account or play with our app. When you book or buy a gift card, you expressly agree to them. This is a translation; if it differs from the Dutch version, the Dutch version prevails.
1. Who we are
GPS City Game is a trade name of 123fun B.V.
Amperelaan 7-8, 9207 AM Drachten, the Netherlands
Chamber of Commerce (KvK) 85832758 · VAT NL863759373B01
Email contact@gpscitygame.com · phone +31 (0)85 130 1491
In these terms:
- we or us: 123fun B.V., trading as GPS City Game;
- organiser or you: whoever books a game or has an account, as a company, school, club or private person;
- consumer: an organiser who books as a private person, not for a trade or business;
- game: a GPS game or city tour you book with us, including your own tour;
- players: the participants who play with a code in our app;
- portal: the environment at app.gpscitygame.com where you book, set up and follow the game.
Partners (sharing, selling or making their own games) also make separate arrangements with us. Where they differ, those arrangements prevail.
2. Booking a game
- You book through our website or the portal. You choose a game, the number of teams and any extras, and see the price beforehand.
- Prices are in euros, including VAT, per team or per game, as shown with the game. A temporary offer only applies within the period shown with it.
- The agreement is made as soon as you complete the booking. You receive a confirmation by email and see the booking in the portal.
- If you book without an account, we create one for you on the email address you give.
- A trial game in the portal, to test your own route, is free. A trial game is not for actually playing with a group.
3. Payment
- On account: only for organisers we have approved for it, possibly up to a credit limit. You pay within 14 days of the invoice date.
- Invoices and credit notes are in the portal. We do not send them by post or as an attachment.
- If you do not pay on time, we send reminders. If payment still does not follow, we may charge statutory interest and reasonable collection costs. For a consumer we only do so after a reminder that gives you another 14 days to pay.
4. Discount codes and gift cards
- A discount code only applies to the games, the period and the number of uses shown with it, and cannot be exchanged for cash. One discount code applies per booking. If you later make a booking smaller, the discount is recalculated in proportion.
- A gift card is a credit in euros, valid for 12 months from purchase. You use it to pay for (part of) a booking; whatever is left stays on the card until it expires. A gift card cannot be exchanged for cash and cannot yet be used for bookings on account.
- You can cancel an unused gift card free of charge within 14 days of purchase; you then get the full amount back. Email contact@gpscitygame.com to do so.
- If a booking paid (partly) with a gift card is cancelled, the gift card's share goes back onto the card, not to your account.
5. Changing and cancelling
Until the game starts, you can add or remove teams or extras in the portal, or cancel the game.
- More teams or extras: you pay the difference.
- Fewer teams or extras, or cancelling: what you have already paid or what has already been invoiced comes back to you through a credit note, minus 10% administration costs on the part that falls away. We charge nothing on an amount that has not yet been paid or invoiced. A refund goes to the account or card you paid with.
- Once the game has started, its content and price are fixed and you can no longer change or cancel it.
6. Right of withdrawal
An organiser booking as a business has no right of withdrawal.
If you book as a consumer, you expressly ask at booking for immediate access to your game: the portal to set up the game straight away, and the codes for your players. With a separate tick box, you also declare that you thereby lose your 14-day right of withdrawal. We confirm this in the booking email. You can still change and cancel afterwards as set out in article 5.
A gift card does carry a 14-day right of withdrawal (article 4).
7. Validity of a booking
A booked game must start within 12 months of the booking. If it does not start within that time, the booking expires. An expired booking can no longer be played or extended. What you paid is then not refunded, unless the law provides otherwise.
8. Playing the game
The organiser is responsible for the game they organise, and:
- chooses the play area and checks in the portal that every point is safely and publicly reachable, moving any point that is not;
- tells the players that they play with our app, what happens to their data (see our privacy statement) and, where needed, their parents or guardians;
- provides suitable supervision for players under 16;
- gives the codes only to their own players.
Players play at their own risk. They obey traffic rules and the law, do not enter private property or closed-off places, and watch their surroundings rather than only the screen. The app never tells anyone to go to unsafe places.
The app is free and works on a suitable phone with internet, location and enough battery. We provide the app and the servers; the players provide the phone, mobile internet and its costs themselves. GPS is not equally accurate everywhere, for example between tall buildings or indoors. That can affect the game, but is not a shortcoming on our part.
Game rules and scores are decided by our system according to the game's rules, as described in its guide. Anyone who deliberately disrupts the game or cheats, for example by faking the phone's location, may lose points under the game's rules as a result. In case of misuse, we may block a code or an account.
9. Your own routes, tasks and uploads
- What you make or upload yourself (routes, tasks, texts, photos, sound, video) remains yours. You allow us to store it, adapt it for display and show it to your players, for as long as our service needs it.
- You are responsible for that content yourself. You hold the rights to it and post nothing that is unlawful, offensive or harmful, or that sends players to unsafe places. We may remove such content.
- A storage limit applies per account. We keep uploads and game data for as long as our privacy statement says.
- You may only use or copy our own routes and tasks as the portal allows.
10. Your account
- Your account is personal or for your organisation. Keep your login details secret; whatever happens through your account is your responsibility.
- In case of misuse, fraud or unpaid invoices, we may block your account.
- We delete an account that has not been used for 2 years, after warning you by email a month beforehand. You can also have your account deleted yourself (see the privacy statement).
11. Availability
We do our best to keep the app and the portal working well at all times, but cannot guarantee they will never fail or be interrupted, for example because of maintenance or problems with internet and map services. If a game cannot go ahead or cannot be finished because of a failure on our side, you may play it again. If that no longer suits you, you receive a gift card worth what you paid for the game, valid for 12 months. In that case we do not refund money.
We may improve and change games, the app and the portal. A game you have already booked keeps the rules and the price that applied when you booked, apart from minor improvements.
12. Liability
- Playing is at your own risk. We are not liable for injury, damage or loss during the game, unless it results from intent or gross negligence on our part.
- If we are liable nonetheless, our liability is limited to the amount you paid for the game concerned. We are not liable for indirect damage, such as lost revenue or consequential loss.
- These limitations do not apply in case of intent or gross negligence, and go no further than the law allows for consumers.
13. Force majeure
If force majeure, such as a failure at a service provider, a network outage or government measures, prevents us from fulfilling our part, we are not liable. A booked game has no fixed date: in bad weather or for any other reason not to play, you choose another day within the validity period yourself.
14. Rights to the app and the games
The app, the portal, the games, the game rules, our routes, texts, images and the GPS City Game brand belong to us or our licensors. You may only use them to book, set up and play our games. Copying, imitating or reselling them is not allowed without our written permission.
15. Reviews
After a game we ask players for a review. We only post a review on our website with separate consent, without the team name. That consent can always be withdrawn.
16. Complaints
If you have a complaint about a booking, an invoice or the game, email contact@gpscitygame.com as soon as possible, with a clear description. We respond within 14 days. If we cannot resolve it together, a consumer can take the matter to court.
17. Privacy
How we handle the personal data of organisers and players is set out in our privacy statement.
18. Changes and applicable law
- We may change these terms. A change does not apply to bookings already made, unless it is to your advantage. We announce important changes in advance.
- Dutch law applies to these terms and to every agreement with us.
- Disputes are brought before the competent court in the district of Noord-Nederland. A consumer may also choose the court of their own place of residence.
